Understanding Homelessness: The McKinney-Vento Act

The McKinney-Vento Homeless Assistance Act is a federal law that protects the educational rights of children and youth experiencing homelessness. Under this act, students who lack a fixed, regular, and adequate nighttime residence are entitled to specific rights and services.

Who Qualifies as Homeless?

Children and youth who are:

• Living in shelters, motels, or campgrounds
• Sharing housing with others due to economic hardship
• Living in cars, parks, or other public spaces
• Unaccompanied youth (not in the physical custody of a parent or guardian)
